These Terms of Use (“Terms”) govern your use of [truckeedancefactory.com] (the “Site”) and any related services offered through the Site. By accessing or using the Site, you agree to these Terms.

1. Who We Are

The Site is operated by Truckee Dance Factory (“TDF,” “we,” “us,” or “our”).

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site on your own. Parents/guardians may use the Site on behalf of minors.

3. Changes to the Site or Terms

We may update the Site and these Terms at any time. Continued use after changes means you accept the updated Terms.

4. Studio Policies; Enrollment; Purchases

Class enrollment, tuition, refunds/credits, attendance, conduct, dress code, and performance policies may be governed by separate studio policies or agreements provided during registration or at the studio. If those policies conflict with these Terms, the studio policies control for enrollment-related matters.

5. Intellectual Property

All content on the Site—text, images, logos, videos, graphics, and design—is owned by TDF or its licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our written permission.

6. Acceptable Use

You agree not to:

  • Use the Site for unlawful purposes;

  • Attempt to interfere with Site functionality or security;

  • Upload malware or harmful code;

  • Harvest personal information about others without permission;

  • Misrepresent your identity or submit false information.

7. User Submissions

If you submit content (e.g., reviews, inquiry form messages, photos you provide), you grant TDF a non-exclusive, worldwide, royalty-free license to use it for business purposes (e.g., responding to you, operating the Site). If you want a narrower license, put it in writing when you submit.

8. Third-Party Services and Links

The Site may integrate third-party tools (payments, scheduling, analytics, social media). We are not responsible for third-party sites or services.

9. Disclaimers

The Site is provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, TDF will not be liable for indirect, incidental, consequential, special, or punitive damages arising from or related to your use of the Site.

11. Indemnification

You agree to indemnify and hold harmless TDF from claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or violation of these Terms.

12. SMS/Text Messaging Terms (RingCentral-Compliant Disclosures)

If you opt in to receive text messages from TDF, the following terms apply:

Program name & description: Truckee Dance Factory Text Messages (class reminders, schedule updates, studio announcements, and optional promotions).

How you opt in: By providing your mobile number and consenting through our forms, registration flow, or by requesting texts from us. Consent is required before sending SMS.

Message frequency: Varies.

Costs: Message and data rates may apply.

Opt-out: Reply STOP to cancel messages. After you opt out, you may receive one final confirmation message. Standard opt-out keywords such as STOP/UNSUBSCRIBE/CANCEL/END/QUIT are supported.

Help: Reply HELP for help or contact:

Privacy: Your participation is subject to our Privacy Notice. We do not sell or rent your phone number, and mobile information will not be shared with third parties for their marketing/promotional purposes (service providers may process messages on our behalf). (This aligns with common carrier expectations and RingCentral compliance guidance on consent/opt-out practices. )

Prohibited content: You may not use our SMS channel to request or engage in unlawful activity; we also follow carrier/RingCentral restrictions on prohibited campaigns and content categories.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.

14. Dispute Resolution

Option A (simple): Any dispute arising from these Terms will be brought in state or federal courts located in California, and you consent to personal jurisdiction there.
